Alec BaldwinThe actor’s manslaughter trial took an unexpected turn Friday when his defense filed a surprise motion to dismiss the actor’s case over questionable ammunition evidence.
Spiro argued that prosecutors concealed evidence related to ammunition that may have been linked to the shooting death of the cinematographer. Halina Hutchins Western”rust” will be held in 2021.
The film’s weapons maker, Hannah Gutierrez Reed, was scheduled to testify today but her testimony has been postponed. She has already been convicted of manslaughter and sentenced to 18 months in prison.
During a rehearsal for a shooting scene in 2021, a prop gun Baldwin was holding accidentally went off, killing Hutchins and He injured manager Joel Sousa. Baldwin was charged with manslaughter and faces 18 months in prison.
On Wednesday, the jury heard opening statements, with the prosecutor saying: Hollywood The star failed to perform a safety check and handled the revolver recklessly before the fatal incident.
“Baldwin was playing with a real gun and violating basic firearm safety rules,” Special Prosecutor Erlinda Ocampo Johnson said.
But attorney Alex Spiro said, “These ground rules are not ground rules on a movie set.”
Baldwin stared solemnly at the screen as witnesses called the 911 call and graphic body camera footage of emergency responders trying to save Hutchins’ life were played.
“Futility of effort”
The ammunition at the center of Friday’s explosion was turned over to crime scene technicians by a “good Samaritan” who claimed to have obtained it from Seth Kenney, owner of PDQ Props and “Last” props supplier, after the trial of defendant Hannah Gutierrez Reed.
During questioning, Special Counsel Kari Morrissey established that the ammunition was supplied by Troy Teske, a friend of Gutierrez Reed’s father.
State officials say the bullet doesn’t match one found at the scene because the primer is a different color.
“This is a wasted effort,” Morrissey said. “It has absolutely no evidentiary value.”
But the defence argued that it was not her decision to make and that she should have made that clear to the defence.
The judge demanded to see the circulars, donned blue gloves, and instructed crime scene technician Marissa Poppel to go through each one.
Morrissey argued that the ammunition had no evidentiary value, but the defense argued that was not for Morrissey to decide and that he should have disclosed that to the defense.

Defense files surprise motion to dismiss case over ammunition evidence
Alec Baldwin’s defense has filed a motion to dismiss the case because evidence regarding ammunition is in dispute.
The defense argued that prosecutors concealed evidence related to ammunition that may have been linked to the 2021 shooting death of cinematographer Halina Hutchins on the set of the film “Lust.”
Prosecutors argue the ammunition was not connected to the crime and was not concealed.
The issue was brought before crime scene technician Marissa Poppel on Thursday after Baldwin’s lawyer, Alex Spiro, suggested in questioning that Poppel and other authorities had a close relationship with the film’s firearms supplier, Seth Kenney, and had not adequately investigated whether Kenney was responsible for live ammunition getting to the set.
During questioning, Special Counsel Kari Morrissey established that the ammunition supplier was Troy Teske, a friend of the father of the film’s arms manufacturer, Hannah Gutierrez Reed.
Morrissey said the bullets were different in size and chemical composition to live bullets found on the set of “Lust,” including the one that killed Hutchins.

Judge dismisses weekend jury

“The case is fluid,” Judge Marlowe Sommer tells them.
They’re scheduled to return on Monday at 10:30 a.m. ET.

Prosecutors have been slow to call witnesses, causing delays in the trial schedule.

Will Hannah Gutierrez Reed testify?
Questions remain about whether Hannah Gutierrez Reed, an arms maker on the set of “Lust,” will testify Friday in Alec Baldwin’s manslaughter trial, or whether she will testify at all.
She was transferred from jail to a court in Santa Fe, where her lawyers say she will plead guilty under the Fifth Amendment.
Special Counsel Kari Morrissey has reportedly not yet decided whether to call Gutierrez Reed to testify.
Gutierrez Reed has already been convicted of manslaughter and sentenced to 18 months in prison.
